Terms of Service

1. Agreement to Terms

By accessing or using NextBite ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

NextBite is an intelligent dining recommendation service that helps users decide where to eat. The Service uses your meal history, location, and restaurant data from Google Maps to provide personalized dining suggestions. Key features include:

  • Personalized restaurant recommendations based on your meal history and preferences
  • Interactive map-based restaurant exploration powered by Google Maps
  • Meal logging and history tracking
  • Cuisine preference learning over time

3. User Accounts and Authentication

The Service uses Clerk for user authentication. When you create an account, you may authenticate via email, social login providers (such as Google), or other methods supported by Clerk. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others
  • Distribute spam, malware, or other harmful content
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Circumvent security measures or access restricted areas of the Service
  • Scrape or collect data from the Service without authorization
  • Use automated tools (bots, scrapers) to access the Service excessively
  • Impersonate another person or entity

5. Third-Party Services

NextBite integrates with the following third-party services. Your use of these services is subject to their respective terms:

  • Google Maps Platform: Restaurant data, maps, and place information are provided through the Google Maps JavaScript SDK. Your use is subject to the Google Maps Platform Terms of Service.
  • Clerk: Authentication is handled by Clerk, subject to the Clerk Terms of Service.
  • Cloudflare: The Service is hosted on Cloudflare Workers and uses Cloudflare D1 for data storage.

6. Data Usage and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

7. Intellectual Property

The Service and its original content (excluding user-generated content and third-party data such as Google Maps restaurant information) are the property of NextBite and are protected by copyright, trademark, and other intellectual property laws.

Restaurant information, ratings, photos, and map data are provided by Google and remain the property of Google and the respective content owners.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Restaurant information (hours, menus, prices, ratings) is accurate or current
  • Recommendations will match your dietary needs, allergies, or preferences
  • The results from using the Service will meet your expectations

Important: NextBite does not provide dietary, medical, or nutritional advice. Always verify restaurant information directly and communicate any food allergies or dietary restrictions to the restaurant.

9. Limitation of Liability

To the maximum extent permitted by applicable law, NextBite and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with:

  • Your use of or inability to use the Service
  • Any dining experience resulting from our recommendations
  • Inaccurate restaurant information
  • Unauthorized access to or alteration of your data
  • Any third-party content or conduct

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may terminate your account at any time by requesting account deletion. Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

12. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration or small claims court, at the election of the claimant.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NextBite operates, without regard to conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
